General Terms & Conditions

Scope of application

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all legal transactions concluded via the online store www.laboiteabricot.ch , www.laboiteabricot.com (hereinafter referred to as “Online Shop”). The online store is operated by La Boîte Abricot Sarl (hereinafter referred to as “La Boîte Abricot”). By placing an order in the online store, the customer confirms the unrestricted acceptance of these GTC.

 

Contractual partner

The contractual partner is La Boîte Abricot SARL registered in the Commercial Register of the Canton of Vaud under company number CHE-

 

Conclusion of contract

The contract for products or services (hereinafter both together referred to as “products”) between the clientele and La Boîte Abricot is concluded as soon as the clientele places its order in the online store (purchase contract). La Boîte Abricot reserves the right to refuse the order.

The arrival of an online order is indicated to the customer by means of an automatically generated order confirmation sent to the e-mail address provided by the customer. The receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered or the service performed.

 

La Boîte Abricot is authorized to reject an order at any time without giving reasons.

 

Products and prices

Images of products in the online store are for illustrative purposes and are not binding. The offers of products in the online store are directed exclusively to customers with residence or company headquarters in Switzerland. Deliveries abroad are only possible by separate written agreement with La Boîte Abricot.

The prices listed by La Boîte Abricot in the online store at the time of ordering shall apply. Obviously erroneous price quotations are not binding.

Availability, prior sale and price changes are expressly reserved.

The prices in the online store are net including VAT (plus shipping).

La Boîte Abricot reserves the right to change the prices of its products at any time and without notice. In any case, the customer will only be charged the price stated in the online store on the day of his order.

 

Payments for orders in the online store have to be made either against payment during pickup in the store or by credit card.

 

Terms of payment

Invoices are payable within 30 days.

 

The processing of payments in the online store by credit card is handled by Stripe. The data is encrypted by SLL protocol and transmitted for processing and settlement.

 

Special offers

La Boîte Abricot may offer sales and special offers through its online store. These offers are only valid as long as they are published on the website and cannot be claimed retroactively.

 

Availability and delivery time

La Boîte Abricot states availability and delivery times in the online store as accurately as possible. However, this information is without guarantee and may change at any time, as there may be delays in delivery, in particular due to production or delivery bottlenecks.

 

Shipping

The delivery of the ordered products is usually within 2-4 business days by Swiss Post. A shipping fee of CHF 9.00 will be charged. The delivery address of the customer must be in Switzerland and easily accessible by truck. If this is not the case, the customer bears the possible additional costs. From a purchase value of 50 CHF, shipping within Switzerland is free (surcharge furniture / bulky goods excluded).

Furniture deliveries & bulky goods deliveries and any deliveries abroad are excluded from this flat rate shipping. These costs are calculated individually and communicated to the customer on request. Goods that are considered furniture or bulky goods are marked as such.

In case of mixed orders of furniture and other products, La Boîte Abricot will deliver all products to the customer together with the furniture delivery. The shipping costs are borne by the customer and are based on the cost of shipping furniture.

 

Transport damages

Should the ordered products show external damage (packaging) upon receipt, the customer must provide a detailed description of the damage on the delivery bill and include the remark “subject to reservation” and return a copy of the delivery bill to La Boîte Abricot. If the customer finds damage to the ordered product, which is due to the transport, he has to note this accordingly with “transport damage” on the delivery bill and send it back to La Boîte Abricot. It shall also have the right to refuse acceptance and to return the products to La Boîte Abricot. However, this must be done at the latest within three working days after receipt of the ordered products to La Boîte Abricot Sarl 282A Route de Sauverny, 1290 Chavannes-des-Bois. Photos of the damaged part(s) must be enclosed.

In the event of transport damage, the customer must immediately have the facts recorded by an expert. Any consequences arising from non-compliance with this provision shall be borne by the customer.

 

Returns

There is a general right of return and exchange within a maximum of 10 days after receipt of the products. Returns are the responsibility and expense of the customer. Prerequisite for a return or exchange is that the products are in perfect condition and in the original packaging. Damaged or used products will not be taken back or exchanged by La Boîte Abricot. The same applies to reduced goods, these are also excluded from exchange. Vouchers and hygiene products are excluded from the right of return and exchange. A refund will be made to the account used by the clientele for the purchase.

Products to be exchanged that cannot be sent to the customer (e.g. due to incorrect address) will be kept by La Boîte Abricot for three months and then disposed of or used elsewhere.

 

Registration

If the customer creates a customer account, he is obliged to provide truthful information, to treat all access data confidentially and not to make it accessible to unauthorized third parties.

 

Warranty

After receipt of the ordered products the customer has to check them immediately for completeness, intactness as well as freedom from defects and functionality. Any complaints are to be reported within 5 working days to La Boîte Abricot in writing and with a photo of the alleged defect either by e-mail to info@laboiteabricot.ch or by letter to the aforementioned return address. The notification will be reviewed by La Boîte Abricot. If the defect is accepted by La Boîte Abricot, a replacement product will be sent to the customer immediately. If the product is not available, the amount of the ordered defective product will be refunded. Further warranty claims are expressly excluded.

 

In the event of improper handling or modifications to the ordered product by the customer or third parties, any claim for replacement or reimbursement shall expire.

For information on the warranty for freedom from defects and functionality of the products, please contact La Boîte Abricot. This warranty period continues regardless of the provision of any replacement services or refunds of purchase prices.

 

Liability and exclusion

Liability is generally governed by the applicable statutory provisions. However, La Boîte Abricot shall in no case be liable for indirect and consequential damages and loss of profit, for damages resulting from delay in delivery as well as for acts and omissions of auxiliary persons, neither contractual nor non-contractual.

Furthermore, any liability is expressly excluded for the following cases:

– Improper, non-contractual or unlawful storage, adjustment or use of the products;

– use of incompatible spare parts or accessories;

– improper modification or repair of the products by the customer or a third party; and

– force majeure such as, in particular, damage caused by natural hazards, moisture, impact, etc., as well as official directives.

 

Default of payment

If the customer fails to meet a payment obligation in whole or in part, all outstanding amounts owed by the customer to La Boîte Abricot under any title shall immediately become due for payment and La Boîte Abricot may immediately demand payment and stop further deliveries of articles to the customer.

For reminders La Boîte Abricot charges a handling fee of CHF 5.00 per reminder. In the event of unsuccessful reminders, the invoice amounts can be assigned to a company entrusted with the collection. The company entrusted with the collection will claim the outstanding amounts in its own name and for its own account and may charge additional processing fees.

 

Retention of title

Ordered products remain the property of La Boîte Abricot until full payment has been made to La Boîte Abricot. La Boîte Abricot is entitled to make a corresponding entry in the retention of title register.

 

Change of order or cancellation

Orders oblige the customer to accept the ordered items. Subsequent changes or cancellations of orders are generally not possible. However, it is left to La Boîte Abricot’s discretion to accept such a change or cancellation anyway. In such a case, La Boîte Abricot shall be entitled to charge a handling fee of 20% of the changed or cancelled order value, but at least CHF 60.00, as well as any loss in value of the cancelled or changed products since their order.

 

Data protection

The privacy policy applies to the processing of personal data by La Boîte Abricot.

 

Accessibility of the website

A claim to permanent accessibility of the website or access to the data or other services offered does not exist. La Boîte Abricot also does not guarantee that the platform or parts of the services are permanently available.

 

Place of jurisdiction and applicable law

All legal relations between La Boîte Abricot and its customers are subject to Swiss substantive law. The UN Convention on Contracts for the International Sale of Goods (CISG) and other international conflict of laws provisions are expressly excluded.

For legal actions by consumers, their place of residence or Founex, Vaud shall be the place of jurisdiction. In all other cases, Founex, Vaud shall be the exclusive place of jurisdiction.
